These Terms and Conditions set out the basis on which Waste Clearance Wandsworth supplies waste collection and related services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means the individual, business, company or organisation that requests or receives services from Waste Clearance Wandsworth.
Services means any waste clearance, rubbish removal, waste collection, recycling, transportation, loading, or related services provided by Waste Clearance Wandsworth.
Waste means any items, materials, goods, junk, rubbish, debris, or other matter that the Customer asks to be removed, collected, or disposed of.
Agreement means the contract between the Customer and Waste Clearance Wandsworth for the provision of Services, incorporating these Terms and Conditions and any written confirmation or quotation issued by Waste Clearance Wandsworth.
Waste Clearance Wandsworth provides waste collection and clearance services primarily within Wandsworth and surrounding areas. Acceptance of a booking is subject to service availability and operational feasibility at the requested address.
The Customer confirms that they are legally entitled to request removal of the Waste from the property and that they have obtained any necessary permissions from the property owner, landlord, local authority, management company or any other relevant party.
3.1 Booking requests
The Customer may request a booking by telephone, email or through any other booking method offered by Waste Clearance Wandsworth. When making a booking request, the Customer must provide accurate and complete information about:
the collection address and access arrangements
the type, approximate quantity and nature of Waste to be removed
any items that may be hazardous, heavy, bulky, or difficult to access
any parking restrictions or time limits near the property.
3.2 Quotations
Any price indications or quotations given before the team arrives on site are based on the information provided by the Customer and are not binding if that information is inaccurate or incomplete. The final price will be confirmed on site once the Waste has been inspected and weighed or assessed, as applicable.
3.3 Acceptance of bookings
A booking is only confirmed when Waste Clearance Wandsworth accepts the request and provides confirmation. Waste Clearance Wandsworth reserves the right to decline any booking at its discretion.
3.4 Access and attendance
The Customer must ensure that Waste Clearance Wandsworth has safe, reasonable and timely access to the Waste at the agreed time. If the team is unable to gain access, or if there are delays caused by the Customer or third parties at the premises, additional waiting time, cancellation or call-out charges may apply.
4.1 Scope of services
Waste Clearance Wandsworth will provide the Services as described in the booking confirmation, which may include loading, removal, transportation and disposal or recycling of the Waste in accordance with applicable waste regulations.
4.2 Exclusions and hazardous materials
Waste Clearance Wandsworth does not accept certain types of Waste, including but not limited to:
explosive, corrosive, flammable or otherwise hazardous materials
clinical or medical waste, needles, sharps or biological waste
asbestos or materials containing asbestos
gas cylinders, chemical containers, solvents or oil drums unless otherwise agreed in writing.
If such items are discovered during the provision of Services, Waste Clearance Wandsworth may refuse to remove them, adjust the price, and in some cases terminate the Service for health and safety reasons.
4.3 Waste ownership
Once the Waste has been loaded onto the vehicle, it becomes the property of Waste Clearance Wandsworth. The Customer warrants that all Waste provided for removal is owned by them or that they have full authority from the legal owner to arrange for its disposal.
5.1 Pricing structure
Charges for Services are generally based on the volume, weight, type of Waste, time on site, and any special handling required. Any additional charges such as congestion, parking, or permit fees may be added and will be explained to the Customer where reasonably possible.
5.2 On-site adjustment of price
If the actual type or quantity of Waste differs from that described when the booking was made, Waste Clearance Wandsworth may adjust the quoted price accordingly, including increasing the price to cover additional Waste or reducing the price if there is less Waste than anticipated. The Customer will be informed of any change in price before work continues.
5.3 Payment terms
Unless otherwise agreed in writing, payment is due immediately upon completion of the Services. Waste Clearance Wandsworth accepts common payment methods including card and bank transfer. Cash may be accepted at the discretion of Waste Clearance Wandsworth.
For business Customers with agreed account terms, invoices must be paid within the period specified on the invoice. Waste Clearance Wandsworth reserves the right to charge interest on overdue amounts at the statutory rate allowable under UK law, as well as reasonable debt recovery costs.
5.4 Failure to pay
If the Customer fails to make any payment when due, Waste Clearance Wandsworth may suspend or cancel any further Services and may take legal action to recover the outstanding sums, together with costs and interest.
6.1 Customer cancellations
The Customer may cancel a booking by giving reasonable notice before the agreed collection time.
If the Customer cancels more than 24 hours before the scheduled time, no cancellation fee will usually apply.
If the Customer cancels less than 24 hours before the scheduled time, Waste Clearance Wandsworth reserves the right to charge a reasonable cancellation fee or call-out charge to cover costs incurred.
6.2 Amendments
The Customer may request changes to the booking time, date or scope of Services. Any amendments are subject to availability and to Waste Clearance Wandsworths agreement. Changes may affect the price or the ability to complete the work in one visit.
6.3 Cancellations by Waste Clearance Wandsworth
Waste Clearance Wandsworth may cancel or postpone the Services due to circumstances beyond its reasonable control, including severe weather, vehicle breakdown, staff illness, safety concerns, or access issues. In such cases, Waste Clearance Wandsworth will endeavour to reschedule the Service as soon as reasonably possible. Waste Clearance Wandsworth will not be liable for any loss arising from such cancellations, but no charge will be made for Services not provided.
7.1 Access and preparation
The Customer must ensure that:
the Waste is safely accessible to the collection team
parking or loading arrangements are in place where necessary
any gates, doors or access routes are unlocked and clear
pets and children are kept away from the working area during the clearance.
7.2 Safe environment
The Customer must inform Waste Clearance Wandsworth in advance of any known risks at the property, including structural issues, unsafe flooring, broken glass, or hazardous materials. If the team considers a situation unsafe, they may refuse to proceed or may adjust the Service to maintain health and safety.
7.3 Accuracy of information
The Customer is responsible for providing accurate information about the Waste, including its nature, approximate quantity and any special handling requirements. Waste Clearance Wandsworth is not responsible for delays, additional costs or refusal of services resulting from inaccurate or incomplete information.
8.1 General liability
Waste Clearance Wandsworth will exercise reasonable care and skill when providing Services. However, liability for any loss or damage to property or belongings arising in connection with the Services is limited as set out in this section.
8.2 Exclusions of liability
Waste Clearance Wandsworth is not liable for:
pre-existing damage, wear and tear, or structural defects at the property
any loss or damage arising from the Customers failure to provide accurate information or suitable access
indirect, consequential or economic losses, including loss of profit, loss of business or loss of opportunity
items removed as Waste where the Customer has not clearly separated or identified items that should not be disposed of.
8.3 Limitation of liability
To the fullest extent permitted by law, Waste Clearance Wandsworths total liability for any claim arising out of or in connection with the Services is limited to the amount paid or payable by the Customer for the specific Service giving rise to the claim.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other matter where liability cannot be excluded under UK law.
9.1 Legal obligations
Waste Clearance Wandsworth operates in accordance with applicable UK waste management laws and regulations, including duty of care obligations relating to the storage, transportation and disposal of controlled waste.
9.2 Disposal and recycling
All Waste collected will be transported to authorised facilities for disposal, treatment or recycling as appropriate. Waste Clearance Wandsworth aims to recycle and divert as much waste from landfill as is reasonably practicable, subject to local infrastructure and material types.
9.3 Prohibited behaviour
The Customer must not ask or encourage Waste Clearance Wandsworth to dispose of Waste unlawfully, including fly-tipping or using unauthorised sites. Waste Clearance Wandsworth will refuse any request that would contravene environmental or waste regulations.
9.4 Documentation
Where required by law, appropriate documentation such as waste transfer notes will be completed for the collection, transport and disposal of Waste. Business Customers may be required to provide their details for inclusion on such documents.
If the Customer is dissatisfied with any aspect of the Services, they should notify Waste Clearance Wandsworth as soon as possible, providing details of the issue and supporting information where available.
Waste Clearance Wandsworth will investigate complaints and seek to resolve them promptly and fairly. The Customer agrees to allow a reasonable opportunity for Waste Clearance Wandsworth to rectify any service-related issues before pursuing additional remedies.
Waste Clearance Wandsworth will collect and process personal data about Customers for the purposes of arranging and delivering Services, processing payments and managing accounts. Personal data will be handled in accordance with applicable UK data protection laws.
By booking Services, the Customer consents to the use of their personal data to the extent necessary to fulfil the Agreement and any legal obligations. Customers may request access to their personal data or ask for corrections where information is inaccurate.
Waste Clearance Wandsworth may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that specific Agreement. Updated terms may be applied to future bookings after being made available to Customers.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services provided by Waste Clearance Wandsworth shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
14.1 Entire agreement
These Terms and Conditions, together with any written quotation or confirmation issued by Waste Clearance Wandsworth, constitute the entire agreement between the parties in relation to the Services and supersede any prior understanding or arrangements.
14.2 Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
14.3 No waiver
Failure or delay by Waste Clearance Wandsworth in exercising any right or remedy under these Terms and Conditions shall not constitute a waiver of that right or remedy, and no single or partial exercise of any right or remedy shall prevent any further exercise of that or any other right or remedy.
14.4 Assignment
The Customer may not assign, transfer or subcontract any of their rights or obligations under the Agreement without the prior written consent of Waste Clearance Wandsworth. Waste Clearance Wandsworth may assign or subcontract its rights and obligations where necessary to deliver the Services and comply with legal obligations.
By placing a booking with Waste Clearance Wandsworth, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
